1. Agreement to Terms
By accessing or using Prior.Run (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Service Description
Prior.Run is a pre-launch design validation platform. You upload one design or compare two variants, and our system produces a structured decision memo that shows what to ship, what to fix, and where risk lives — including friction analysis, audience reactions, and compliance flags.
3. Account Terms
- You must provide a valid email address to create an account.
- You are responsible for maintaining the security of your account credentials. Do not share your password or allow others to access your account.
- You are responsible for all activity that occurs under your account.
- You must be at least 16 years old to use the Service.
- One person or legal entity may not maintain more than one free account.
4. Acceptable Use
You agree NOT to:
- Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
- Upload content that infringes on the intellectual property rights of others.
- Attempt to reverse-engineer, decompile, or extract the underlying models, prompts, or algorithms of the Service.
- Use automated tools to scrape, crawl, or otherwise extract data from the Service.
- Attempt to circumvent usage limits, rate limiting, or authentication mechanisms.
- Use the Service to compete directly with Prior.Run without written permission.
5. Payment Terms
- Free tier: Limited analyses per month at no cost. No credit card required.
- Pro plan: $99/month, billed monthly via Stripe. Includes unlimited analyses and priority processing.
- Billing: Your subscription renews automatically each month. You will be charged on the same date each month.
- Cancellation: You may cancel your Pro subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided.
- Price changes:We may change pricing with 30 days' advance notice. Continued use after a price change constitutes acceptance.
6. Intellectual Property
Your Content
- You retain all rights to the designs and images you upload.
- By uploading content, you grant Prior.Run a limited, non-exclusive license to process your designs solely for the purpose of providing the analysis service.
- Your designs are not used to train any models.
Our Content
- Prior.Run owns the analysis output format, methodology, interface design, and underlying technology.
- You may use analysis results for your internal business purposes, share memos via our sharing feature, and reference insights in your decision-making.
- You may not resell, redistribute, or white-label analysis outputs as a competing service.
7. Limitation of Liability
Analysis results are advisory, not guaranteed.
- Prior.Run provides design analysis as a decision-support tool. We do not guarantee that our predictions will match real-world A/B test outcomes.
- The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
- In no event shall Prior.Run be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
- Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
8. Termination
- By you: You may close your account at any time by contacting us. Upon closure, your data will be deleted within 30 days.
- By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay for a Pro subscription.
- Upon termination, your right to use the Service ceases immediately. We may retain anonymized, aggregated data for analytics purposes.
9. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes via email at least 14 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you disagree with the changes, you should stop using the Service and close your account.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved through good-faith negotiation first, and if necessary, binding arbitration.
